This page sets out our terms of business, our guarantee plus clarification regarding the conditions under which it is offered. Your statutory rights are not affected.

Purchase of bingbangbong equipment indicates agreement to these terms & conditions unless expressly indicated otherwise in writing.

All Goods remain the property of bingbangbong until paid for in full.

Guarantee

• All bingbangbong products are sold with a standard one year manufacturer's guarantee on item manufacturing and design only.

Order confirmation

• All customer orders will receive a confirmatory response setting out the exact order details and indicating any 'free' elements to be included.

• Please advise us within 24hrs if this is in any way incorrect as your items are constructed from this list and your invoice is based on these details

Liability

• All items are covered within the UK by £1,000,000 Public & Product Liability insurance

• Items shipped outside of the UK are not covered by liability insurance and we require that clients waive any bingbangbong liability and indemnify bingbangbong or its agents against claims arising howsoever caused.
  

Limitations of Use

• Products are intended for use only in a musical / sound exploration / sensory experience context.

• Items are robust and constructed to be 'over strong' for the intended use, Unless described as such, they are never intended to be used for climbing or other forms of 'misuse' or load-bearing activity. No responsibility is accepted for damages or loss arising from misuse howsoever caused.

• With normal use and exposure, items should be functional for many years, many of our products have an indefinite functional lifespan. Some finishes may fade over time. See Below.
  

Installation

• Installation advice offered is general in nature and does not account for your exact local conditions.

• Installation should only be carried out by an approved playground installer.

• Bingbangbong accepts no responsibility for any harm or other effect whatsoever arising from your choice of installation method or site.

Deliveries

• Items are usually delivered using a UK-wide courier service. Small Items may be delivered by Royal Mail
• Please Note Carefully
  
• When you signing for the items with the courier you are accepting them in the condition in which you have received them.
  
• We guarantee that all items shipped from bingbangbong are in pristine condition unless we have described them otherwise in your dealings with us.
• We fully understand that it takes a few minutes to do so,  however YOU MUST OPEN THE PACKAGES AND VERIFY THE CONDITION OF THE GOODS BEFORE SIGNING FOR ACCEPTANCE.
  
• Once you have signed for the goods, you have accepted them 'as-is', the insurance requirement is deemed to have been fulfilled and there is absolutely no come-back with the courier company.
• If you intend to reject the goods because of transit damage, please call bingbangbong 028 91470989 before the driver leaves and if possible take a photograph of the damage to send to us before the driver takes them away again.
• Unless there is a manufacturing or design defect covered under our guarantee, Bingbangbong is under no obligation to replace goods that you have accepted if you have not checked them before accepting them and later find them to be faulty. It is your responsibility to check the proper condition of your goods at the point of delivery.

Billing terms

• As a micro-business bingbangbong is extremely sensitive to cashflow.
  
  Before your goods are delivered to you we are required to purchase raw materials, process those in-house and/or out-source specialist services to create the final product. Our suppliers and service providers are paid before we receive your payment and therefore we rely on prompt payment to keep your order and the orders of all other customers moving promptly.
  
• Unless you have ordered a custom item for which you will receve an estimated delivery date, most items are delivered within 3-4 weeks, we feel it is fair to ask our clstomers to keep the same timescale in making payment.
  
• We offer 10% discount for prompt payment.
  
  With the growth of the business, our small cash and borrowing reserves come under significant pressure. To alleviate such pressure and to speed up the provision of our goods and services to you, we offer a variety of different billing options
  
  
• Prompt Payment
  Standard Website Price less 10% discount - Invoice is issued on the receipt of your order and payment is due within 7 days from invoice date. Goods are shipped immediately after fabrication if payment has been received.
  
  
• Standard 30 Day - Purchase Order
  Price as indicated on the website- An invoice is issued when the goods are dispatched and must be paid within 30 days from the invoice date. This is essentially offering clients 30 days interest-free credit - no further discounts are available
  
  
• 30 Day Plus  - Purchase Order
  Order Value plus 5% charge - An invoice is issued with the goods and must be paid within 60 days of the invoice date. No further discounts are available

• Unpaid / overdue Invoices

Invoices that remain unpaid after their due period will incur a further administration / credit fee based on the balance of your customer account with us and the period overdue.

Threat-resistance

• 'Tamper proof' / 'anti-tamper'/'anti theft' means that the fittings are protected against casual attempts to undo the fixings - Our anti-tamper fixings cannot be undone without some form of tool, usually a non-standard tool or a specialist fixing bit. In some cases anti-tamper measures may take the form of a threadlocking compound to bond nuts and bolts together or any combination of measures available.

Elemental / Environmental

• All standard aluminium based instruments are supplied with a chemically etched protective undercoat and a layer of coloured powdercoating. These are hard wearing, industrial quality finishes, but they can be marked or chipped if struck or scratched with a hard implement.

• Although virtually indestructible as a material, Stainless steel instrument finishes may be scratched or may be dented by striking sufficiently forcefully with a hard implement.

• Stainless Steel instruments are minimum 304 grade as standard and are suitable for any use not requiring permanent immersion in water. 316 grade is available on request.

• Environmental factors such as UV exposure, wind, rain and salty air near a coast, will cause a dulling of cosmetic finishes and colours after a period of exposure. Such cosmetic effects are anticpated and do not affect the instrument/artefact performance.

• Stainless mirror polished spheres and hemispheres have a thin skin that can be dented with aggressive use. Please be aware of this.

• Stainless Steel items may become hot in direct sunlight
• All sound has the potential to carry beyond the area of immediate use particularly against a quiet background. Generally at times of anticipated usage this 'carry' is only for a few metres; however under certain conditions, using unapproved striking implements or with proximate neighbours at a weekend or evening this may constitute a nuisance. Before ordering you should satisfy yourself that your intended installation site is appropriate - bingbangbong accepts no responsibility whatsoever for 'nuisance' use of our products on your site.

Sensory Awareness

• Sensory products are solely designed to provide stimulating and interesting opportunities for exploration and sensation. Individual users will react differently to different stimulii and whilst we can indicate the likely range of uses and effects, no guarantee of effect or benefit whatsoever is given or should be implied.

• Some of the sensory items are designed to give-off extremely strong vibrations and sound waves. Please consider if this is appropriate for your clientele before purchase.

Intellectual property

• Items purchased from bingbangbong may or may not include proprietary original designs and/or design features that represent intellectual property. All designs are covered by copyright and may not be copied, disassembled, reverse engineered or replicated in whole or in part. Breaches of copyright and other intellectual property may be met with a strong legal challenge.

Acceptance of conditions
